General Terms and Conditions (GTC) with customer information

The business relationship between Gall Pharma GmbH, Grünhüblgasse 25, 8750 Judenburg (hereinafter referred to as "Seller") and the customer (hereinafter referred to as "Customer") shall be governed exclusively by the following General Terms and Conditions in the version valid at the time of the order.
 
Order is possible around the clock
At Gall-Pharma you can order around the clock. All orders received by 12 pm will be processed on the same day. We supply customers in Austria as well as in all other countries except USA and Canada. Due to legal or trademark regulations, certain products may not be delivered to certain countries. If you order such a product, we will inform you immediately if the delivery to your country is not possible. The product information on www.gall-shop.com is intended exclusively for Austrian customers. Within Austria, the ordered goods are delivered to our customers within the next two days. For delivery abroad the shipping time takes up to 10 days. For special requests or specially manufactured preparations, an individually agreed delivery time will be set.

Quality warranty and offer
The seller is very eager to deliver only products of the best quality and therefore also ensures correct transport. If the customer is still not satisfied with the quality of a product, you are kindly asked to inform the seller in writing or by phone +43 (0)3572 / 86996. The presentation of the products in the online store is not a legally binding offer, but an invitation to place an order. Performance descriptions in catalogs as well as on the websites of the seller do not have the character of an assurance or warranty. All offers are valid "while stocks last", unless otherwise noted. We reserve the right for errors.
 
Order process and contract conclusion
The Customer can select products from the Seller's assortment without obligation and collect them in a so-called shopping cart via the button [Add to cart]. Subsequently, the customer can proceed to the completion of the order process within the shopping cart via the button [Checkout]. By clicking the button [Order with obligation to pay], the customer places a binding order for the purchase of the goods in the shopping cart. Before sending the order, the customer can change and view the data at any time. Necessary data are marked with an asterisk (*). The seller then sends the customer an automatic order confirmation by e-mail, in which the customer's order is listed again and the customer can print out the confirmation using the "Print" function (order confirmation). The automatic order confirmation merely documents that the order of the customer has been received by the seller and does not constitute an acceptance of the purchase request. The purchase contract is not concluded until the seller has shipped or submitted the ordered product to the customer within 2 days or has confirmed the shipment to the customer within 2 days with a second e-mail, explicit order confirmation or sending of the invoice.
 
Pricing/payment terms and shipping costs
All prices in the online shop from the seller are stated in EURO including the applicable statutory VAT. Terms and conditions of payment: See payment methods. If third-party providers are commissioned with the payment processing, e.g. Paypal, their terms and conditions apply. In addition to the stated prices, the seller charges shipping costs for delivery. The shipping costs are clearly indicated to the customer on a separate information page (shipping information) and during the ordering process.
 
Dunning and collection fees
In case of default in payment, the customer shall reimburse us for the dunning charges at a value of EUR 20,-- per dunning notice as well as an amount of EUR 5,-- per six months for keeping records of the debt obligation in the dunning process. In addition, we shall be entitled to charge interest on overdue payments at a rate of 4% above the secondary market yield/bund according to the monthly statistical issue of the Austrian National Bank.
 
Delivery and availability of goods
If ordered products are not all in stock, the seller is entitled to partial deliveries at his own expense, as far as this is reasonable for the customer.
 
Retention of title and its enforcement
All goods and products are delivered by the seller under reservation of ownership and remain the property of the seller until full payment. The customer bears the full risk for the reserved goods, in particular for the risk of destruction, loss or deterioration. Jurisdiction and place of performance is Judenburg. Austrian law shall apply. Information on online dispute resolution: The EU Commission provides an internet platform for the online settlement of disputes (so-called "OS platform"), which arise from contractual obligations from online purchase contracts. Warranty and guarantee
The warranty is determined by legal regulations.
A warranty exists for the goods delivered by the seller only if this was explicitly given. Customers are informed about the warranty conditions before initiating the ordering process.
 
Liability
The following exclusions and limitations of liability will apply to the seller's liability for damages, without prejudice to the other legal requirements for claims. The seller shall be liable without limitation insofar as the cause of the damage is based on intent or severe carelessness.
Liability under the Product Liability Act remains unaffected. Insofar as the liability of the seller is excluded or limited, this will also apply to the personal liability of employees, representatives, and assistants. Data communication via the Internet cannot be guaranteed to be error-free and/or available at all times according to the current state of technology. Therefore, the seller is not liable for the constant and uninterrupted availability of the online trading system, nor for technical and electronic errors over which the seller has no control, in particular for the delayed processing of the order.
 
Cancellation / Revocation Policy
If the customer is a consumer within the meaning of the Consumer Protection Act, he/she has the right to revoke this contract within 14 days without giving any reason. The revocation period is 14 days from the day on which the customer or a third party designated by him, who is not the carrier, has taken possession of the goods. In order to exercise the right of withdrawal, the customer (fill in your name, address, and if available phone number, fax number and e-mail) must inform Gall Pharma GmbH (Grünhüblgasse 25, 8750 Judenburg, phone: +43 (0) 3572/86996) of the decision to withdraw from this contract by means of a clear declaration (e.g. by post, fax or e-mail). For this purpose, the customer may use the existing model withdrawal form, which can be found here, but is not mandatory. To comply with the withdrawal period, it is sufficient that the customer sends the notification of withdrawal before the expiry of the withdrawal period.
 
Consequence of the revocation
If the customer has revoked this contract, we shall reimburse the customer for all payments we have received, including delivery costs (with the exception of additional costs resulting from the fact that the customer has chosen a type of delivery other than the most favorable standard delivery offered by the seller), without delay and no later than 14 days from the day on which we received notification of the revocation of this contract. The seller may refuse repayment until he has received the goods back or until the customer has provided proof that he has sent back the goods. The customer shall return or hand over the goods to the seller without delay and in any case no later than within 14 days from the day on which the customer informed the seller about the revocation of this contract. The deadline is met if the customer sends the goods before the expiration of the 14-day period. The customer will bear the direct costs of returning the goods. The customer must pay for any loss in value of the goods, if this loss in value is due to a handling of the goods not necessary for the examination of the condition, properties and functioning of the goods. The customer has no right of withdrawal from contracts for:
  • Goods, the price of which depends on fluctuations in the financial market over which the entrepreneur has no control, and which may occur within the withdrawal period,
  • Goods that are manufactured according to customer specifications or are clearly customized to personal needs,
  • Goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene, insofar as their seal has been removed after delivery,
  • Alcoholic beverages, the price of which was agreed upon at the conclusion of the contract, but which cannot be delivered earlier than 30 days after the conclusion of the contract and the current value of which depends on fluctuations in the market over which the entrepreneur has no control,
  • Sound or video recordings or computer software delivered in a sealed package, insofar as the seal has been removed after delivery,
  • Newspapers, periodicals or magazines with the exception of subscription contracts for the delivery of such publications.
 
Personal pick up possible
Ordered goods can also be picked up by private customers at Gall-Pharma GmbH, A-8750 Judenburg, Grünhüblgasse 25. In this case, no shipping costs will be charged. You will receive a 10% cash and pickup discount for cash payment.
 
Transport damage and complaint
Should there be a reason for complaint (e.g. broken or missing ordered products) despite the most careful delivery, we guarantee the customer a full replacement immediately. The customer has to check the incoming goods for correctness and completeness immediately upon receiving them. Transport damage must be confirmed by the carrier and reported to the seller within 14 days of receiving the goods. The customer must return products with qualitative defects within 14 days and make the claim after delivery. Transport damages that have not been confirmed by the transport company cannot be taken into account.
Disclosure and use of information
Use of personal data.
Gall-Pharma uses data exclusively to be able to process the order in the best possible way. This means that only the information and data that are absolutely necessary to clarify any claims for refund will be stored and processed. Furthermore, the customer hereby agrees to receive information material, catalogs, and similar printed articles from Gall-Pharma.
 
Severability clause
If any part of these General Terms and Conditions is found to be invalid, the validity of the remaining terms and conditions shall not be affected thereby.
 
Distribution and accounting
The following items may not be sold to Germany for reasons of trademark law: Lysiherp® Capsules, Alkala N® Powder, Sallaki® 400 mg Tablets, Folbene® Capsules, Biofax® Capsules, Dona® 250 mg Tablets, Lactisol® liquidum Drops, Craton® film-coated Tablets, Phosphonorm® Capsules. The following items may not be sold to Italy for reasons of trademark law: Reumaless® Capsules.
